Familiar yourself with UAE labor law:
The employment contract is for a defined time that cannot exceed three years, by Article 8 of Federal Decree-Law No. (33) Of 2021 (UAE Labor Law), unless both parties agree to renew or prolong its duration. As stated in this Article’s Clause (4):
“When a contract is extended or renewed, the new term(s) will be added to the previous term as part of the calculation for the employee’s total length of continuous employment.”
The “unlimited” contract has been eliminated under the new UAE labor legislation. Only limited/fixed-term contracts are permitted.
Read your employment contract thoroughly:
Before beginning the resignation process, take sure to carefully study the terms and conditions of your employment contract to ensure you are aware of everything. Keep in mind that you can stop your work contract by mutual agreement or by giving one to three months’ notice, depending on the terms of your contract. Many businesses often include a language in their contracts that forbids employees from joining a rival. If your contract contains a clause like this, be careful to follow it.
Absconding is the act of leaving suddenly and covertly without telling a company. An employee can be considered an absconder if they miss work for seven or more days without giving a valid excuse while they are in the United Arab Emirates. Absconding is a crime that carries a possible one-year labor restriction in the UAE.
Need the employer’s permission:
You must decide for yourself whether to leave your current employer. As long as you are providing your employer with the required notice as outlined in your contract, you don’t need to ask for their consent to make such a move. However, it’s best to talk to your employer in advance about your plans so they can make plans to find a successor and make sure a full handover is done before you leave the firm.
Submit a formal resignation letter:
A resignation letter may be submitted in a variety of ways. You have two options for delivering it to your employer: in person or via email. According to the terms of the contract, be sure to be explicit about your intentions and provide the employer with precise dates for your departure.
